1. These terms
These terms govern your organisation's use of Redge. By creating an account, or by using Redge, you agree to them on behalf of your organisation.
"We", "us" and "Redge" mean Lewers Hothouse Pty Ltd, trading as Redge. "You" means the organisation subscribing, and the people it authorises to use the platform.
If you have signed an order form or separate agreement with us, that document applies alongside these terms, and prevails where the two differ.
2. What Redge is
Redge is a hosted platform for designing, fielding and analysing market research studies. It includes an AI interviewer that can ask follow-up questions during an interview, tools for buying sample from panel providers, and reporting.
We may change how the platform works. We will not remove a capability you are relying on without 30 days' notice.
3. Your account
You are responsible for who you let in. Access is by invitation from an administrator in your organisation, and each person's permissions are set by role.
You must:
- keep sign-in credentials secure and not share a login between people;
- remove access promptly when someone leaves your organisation;
- tell us if you believe an account has been compromised.
We may suspend an account that is being used in breach of these terms, and will tell you why.
4. Your research, and what you are responsible for
This is the section that matters most, and it should be read rather than skimmed.
You decide what to ask, who to ask, and what to do with the answers. That makes you responsible for the lawfulness of your research. Specifically, you must:
- have a lawful basis for collecting the personal information your study collects, and obtain consent where consent is required, including for video, which is sensitive information;
- tell respondents what your study is for, where the law or an applicable research code requires it, and tell them before they record if your study analyses facial expressions in video;
- comply with the Privacy Act 1988 (Cth) and any industry code you hold yourself out as following;
- not use Redge to collect information you are not entitled to collect.
We provide tools that help. A study that includes a video question automatically declares to the panel provider that it collects personal information, and the pre-field check reports design faults before you spend money. These are aids, not a compliance review. A clean check means the design holds together, not that the research is lawful or that the questions are the right ones.
5. Acceptable use
You must not use Redge to:
- send unsolicited messages, or field a study to people who have not agreed to be contacted;
- collect information deceptively, including by misrepresenting who is asking or why;
- conduct anything that is not genuine research. Redge is not a tool for marketing, sales prospecting, or gathering data under the cover of a survey;
- attempt to identify individual respondents from data that reached you pseudonymously, or to re-contact them outside the panel's terms;
- interfere with the platform, or attempt to access another organisation's data.
6. Respondents
Where you buy sample through Redge, respondents are supplied by a panel provider under their terms as well as these.
You must treat respondents fairly. In particular, features that end an interview in progress, such as an attention check or termination for speeding, cost that person their incentive and cannot be undone. You choose whether to use them and you are responsible for using them reasonably.
7. Fees
Subscription fees are as shown on our pricing page or in your order form at the time you subscribe. Fees are in Australian dollars and exclude GST unless stated otherwise.
- Billing. Subscriptions are billed in advance, monthly or annually depending on the plan you choose.
- Payment. Invoices are payable within 14 days. If an invoice is more than 30 days overdue, we may suspend access after giving you 7 days' written notice. Your data is not deleted during a suspension.
- Price changes. We will give you at least 30 days' notice of a price change, and it takes effect from your next billing period. A rate we have agreed to hold for you, such as a founding-member rate, is not affected while the conditions of that rate are met.
- Trials. We may offer trial or early-access periods on terms we tell you at the time.
Sample purchased through Redge
Where you commission sample through Redge, the price of that sample is quoted before you commit, and includes Redge's fee for arranging it.
Sample is bought from a third party and, once respondents have been paid, the cost is not recoverable. Estimates of incidence and interview length are estimates; if the study turns out to be harder to field than estimated, the additional cost is yours.
8. Who owns what
You own your research. Your questionnaires, your data, your respondents' answers and your reports are yours. We claim no ownership of them and will not use them for any purpose other than providing the platform to you.
We own the platform. The software, its design, and anything we develop generally remain ours, including improvements suggested by you.
We will not identify you as a client publicly, or describe your research, without your agreement.
9. Artificial intelligence, and its limits
Redge uses AI to moderate interviews, to group open-ended answers into themes, and to help draft reports.
AI output is generated, not verified. It can be wrong, it can miss things, and two runs may not agree. Any finding that matters should be checked against the underlying responses, which the platform gives you access to for exactly that reason. Subject to section 12, we do not warrant that AI-generated questions, themes, or report text are accurate, complete or suitable for any particular purpose.
Open-ended answers are sent to a third-party AI provider for processing, and are not used to train AI models. The Privacy Policy sets out who, and what for.
10. Availability
We aim to keep Redge available at all times but do not guarantee it, and we do not currently offer a service level commitment. Fieldwork in progress is the case we care most about, and we will schedule maintenance to avoid it where we can.
11. Confidentiality
Each of us may learn things about the other that are confidential. Neither will disclose the other's confidential information except to people who need it and are bound to keep it confidential, or where the law requires disclosure.
Your study designs and data are your confidential information. We treat them as such.
12. Warranties and liability
To the extent permitted by law:
- Redge is provided as is. We do not warrant that it will be error-free or that it will meet every requirement you have.
- We are not liable for indirect or consequential loss, or for loss of profit, revenue, data or goodwill.
- Our total liability for all claims in any twelve-month period is limited to the fees you paid us in that period.
Nothing in these terms excludes rights you have under the Australian Consumer Law that cannot be excluded. Where our liability for breach of a consumer guarantee cannot be excluded, it is limited, where the law allows, to resupplying the service or paying the cost of having it resupplied.
13. Indemnity
You indemnify us against claims arising from your research, including a claim by a respondent, a panel provider or a regulator that your study collected information unlawfully, or that you used it in a way you were not entitled to.
14. Ending the agreement
You may cancel at any time, effective at the end of the current billing period. Fees already paid for that period are not refunded, except where the law requires.
We may terminate for material breach that is not fixed within 30 days of us telling you about it.
When the agreement ends, you can export your data. We will keep it available for 30 days after the agreement ends, and then delete it in accordance with the Privacy Policy. Exporting before you cancel is the safer course, and we will remind you.
15. Changes to these terms
We may update these terms. Material changes will be notified by email at least 30 days before they take effect. Continuing to use Redge after that means you accept them.
16. General
These terms are governed by the laws of Victoria, Australia, and both of us submit to the courts of that state.
If any part of these terms is unenforceable, the rest continues to apply.
